Cancellation/Refunds

CANCELLATION OR POSTPONEMENT

All event cancellations or postponements shall result in a forfeiture of the Rental Deposit.  Any additional monies paid may be used as a credit toward another function by the same renter, provided The Loft at Chateau is able to book another event for the same date and time as detailed in this contract.  Cancellation or postponement within 120 days makes the remaining balance due and payable immediately.  Should it be necessary to secure the services of an attorney to collect the unpaid balance, renter shall be liable for all expenses of collection, including but not limited to, court costs and attorney fees fixed at a minimum of 25% of the amount due.  Written notice of cancellation must be received by The Loft at Chateau not less than 120 days prior to the date contracted for. 

 

FORCE MAJEURE, NATURAL DISASTERS, ACTS OF GOD, AND OTHER UNFORESEEN DIFFICULTIES

The Loft at Chateau shall not be liable for any obligation of performance, injury, damage, delays, expense, accident, inconvenience, or irregularity under this contract that result directly or indirectly from a Force Majeure Event.  A “Force Majeure Event” for purposes hereof means any event or circumstances beyond the reasonable control of The Loft at Chateau.  If the contract is not fulfilled due to a Force Majeure Event, natural or unnatural disaster or Acts of God, the event will be rescheduled, and all payments will be reapplied to another open date within one year of this contract.  NO REFUNDS WILL BE ISSUED. Please note that unforeseen or unplanned events, such as military deployments or family illness, may make it necessary to cancel or postpone the event, resulting in possible forfeiture of all monies on the account.
